Running on empty?

BBC reports that Jackson Browne has asserted that the use of his song Running on Empty in a campaign ad by the McCain folks was an infringement of copyright and will lead people to conclude he endorses McCain (the latter sounding in trademark law).

The gist of the use related to ridicule of Barack Obama "for suggesting that the country conserve gas through proper tire inflation", and could equally apply to Obama's copied thoughts in the patent area about gold-plating patents.
