Missouri's Amendment 2 to regulate intent?

Amendment 2 in Missouri tries to distinguish between therapeutic cloning (what Hwang Woo Suk tried to do with SCNT) and reproductive cloning based on INTENT.

MSNBC notes the immediate result of both procedures (therapeautic and reproductive cloning) would be an embryo - and it'd be well nigh impossible to tell the difference between one class and the other.

"If you create an embryo by nuclear transfer, and you give it to somebody who didn’t know where it came from, there would be no test you could do on that embryo to say where it came from. It is what it is," James Thomson said.

Thomson's patents are at issue in the confrontation between CIRM and WARF.
