Sanofi-Aventis files Hatch-Waxman case against Sandoz over Lovenox

Sanofi-Aventis has filed a Hatch-Waxman action against Sandoz, the Swiss generic company owned by Novartix, over Lovenox.

"Sanofi brought suit against Sandoz on Aug. 4 for patent infringement," a Sanofi spokesman said on Wednesday, after Sandoz, the Swiss generic drugmaker owned by Novartis , had warned it in a letter about its plans to market a cheaper copy.
He said two patents protecting Lovenox would expire on Feb. 14 2012 and that the company would do everything to prevent a generic version from reaching the market before that date.

The lawsuit comes as Sanofi is having to come to terms with a cheaper copy of bloodthinner PLAVIX, marketed by generic drugmaker Apotex. The unexpected launch was announced on Tuesday, August 8.
