U.S. government enters BlackBerry injunction fray

In a statement of interest filed with the district court, the federal government stated "it is imperative that some mechanism be incorporated that permits continuity of the federal government's use of BlackBerry devices." Not surprisingly, an attorney for patentee NTP said that US attorney McNulty's filing was "highly inappropriate and misleading."

District court judge James R. Spencer indicated that it was unlikely he would delay his proceedings to wait for conclusion of the parallel re-examinations going on at the USPTO. Spencer said: "I don't run their business and they don't run mine."
