In a statement of interest filed with the district court, the federal government stated "it is imperative that some mechanism be incorporated that permits continuity of the federal government's use of BlackBerry devices." District court judge James R. Spencer indicated that it was unlikely he would delay his proceedings to wait for conclusion of the parallel re-examinations going on at the USPTO. Spencer said: "I don't run their business and they don't run mine."
