PTAB says: “[a] wagering game is, effectively, a method of exchanging and resolving financial obligations based on probabilities created during the distribution of the cards.”

The CAFC affirmed a 101 rejection made by PTAB in the Smith case.

The CAFC did leave open the possibility that patentable inventions in the gaming arts might arise.
