Leahy backs HR 1249 fee diversion language
“The House-passed bill differs slightly from what the Senate approved overwhelmingly in March, but the core reforms are consistent. We should come together and approve this bill once again, and send it to the president’s desk to be signed into law.”
The House-passed version of HR 1249 requires that funding for the USPTO would still be decided by the House through its annual appropriations process, but if patent fee revenues exceed this amount, they would be set aside in a separate account and allocated for future use by the patent office.
Since the House sets the funding level in HR 1249, it is significantly different from the Senate-passed version, which has no such provision.
