Dueling patents: Monster v. CareerBuilder

PatentExpress has a post comparing patents between Monster [US 5,832,497 ]and CareerBuilder [ US 6,370,510 ].

The first claim of US 6,370,510 (which cites US '497) states:

An employment recruiting method, comprising the steps of:

receiving first computer readable data, representing information pertaining to a job, provided by a job seeker user via a computer network;

automatically periodically comparing said first computer readable data to second computer readable data including job opening data representing information pertaining to at least one job opening; and

sending said job seeker user a message informing said job seeker user when said comparing step determines that said first computer readable data matches at least a portion of said second computer readable data, said message including a link to a site at which additional data pertaining to said job opening is accessible by said job seeker user via said link.


US 6,370,510 was most recently cited in US 20110060633 titled METHOD AND APPARATUS FOR RAPIDLY SOURCING RESUMES FOR AN EMPLOYMENT WEBSITE (published March 10, 2011). The first claim of the '633 application states:

An on line incentive-based method for matching job-seekers to potential employers in an internet based employment website including, maintaining a database of job-seekers with means for posting and updating resumes, maintaining a database of employers interested in accessing and viewing the job-seekers resumes, identifying the logged employer by login ID and searching the database of job-seekers that matches the job requirement criteria, allowing the logged employer to access the database of first job-seeker matching the posted job requirement criteria for viewing the detailed profile provided the permission for carrying out steps (a), (b) and (c) are allowed in sequential manner and the logged employer is given the option of carrying out all three steps (a), (b) and (c), the first two steps (a) and (b), only the first step (a) or to skip all and look for next matching profile highlight,repeating the steps for other matching job-seekers, calculating and generating fee payable by the employer accessing the data base according to a pre-determined fee structure,calculating and generating the revenue to be shared by respective job-seeker according to a scheme of revenue sharing so that each job-seeker whose resume is viewed, downloaded or whose contact information is taken by an employer shares a fraction of the fee payable by the employer as incentive for posting his resume.

US '510 was also cited in US 20050125273 titled System and method for interactive coordination of time schedules and project opportunities with first claim:

A system for automated coordination of time schedules and availability with job, assignment, or project opportunities using a network, the system comprising: a web engine operable to communicate with the network and to present a schedule survey form to a client of the network, the web engine further operable to receive from the client schedule data that is entered in the form; and a web engine operable to communicate with the network and to present a project survey form to a client of the network, the web engine further operable to receive from the client project data that is entered in the form; and a schedule mapping engine in communication with the schedule web engine, the schedule mapping engine operable to receive the schedule data from the schedule web engine and to generate at least one schedule identifier in response to parsing the schedule data, the schedule mapping engine further operable to index the at least one schedule identifier in response to the parsed schedule data, the at least one schedule identifier being linked to a schedule record, which schedule record stores the schedule data; and a project mapping engine in communication with the project web engine, the project mapping engine operable to receive the project data from the project web engine and to generate at least one project identifier in response to parsing the project data, the project mapping engine further operable to index the at least one project identifier in response to the parsed project data, the at least one project identifier being linked to a project record, which project record stores the project data.
