Symantec wins summary judgment against SRI

Symantec Corp. stated on Nov. 8, 2006 that it was granted summary judgment in U.S. District Court for Delaware against all patent infringement claims by SRI International Inc.

Somewhat related to the SIU contention that one "can't plagiarize oneself," the district court held that Menlo Park-based SRI's patents were invalid based on prior printed publications authored by SRI employees more than one year before the earliest patent application was filed.

Trying to get credit later for work published earlier can be held against one in the patent world. The same should be true in the academic world, even as to repackaging one's own work.

Symantec has separately filed re-exam requests on some SRI patents.
