Preliminary injunction denied in generic Zocor matter

District Court Judge Royce Lamberth had said he would also consider Sandoz' TRO request as a motion for a preliminary injunction, which he denied on July 12. “If this court enters the injunction requested by Sandoz, however, it will effectively take Ivax and Ranbaxy’s low-cost generic simvastatin product [Zocor] out of the hands of consumers,” Lamberth said in the ruling.

The FDA was trying to allow all generic makers into the market. The FDA has appealed a district court ruling, arguing that all generic versions should be allowed to go to market.
