eBay reply brief: the NPE boogeyman

eBay's reply brief is out. For those that didn't make notes of the earlier brief, an NPE is a non-practicing entity. The 1908 Continental Paper case concerned a non-practicing entity, and did allow that an NPE could get an injunction.

The eBay reply doesn't mention Quillen/Webster. The only law review cite is to a 2005 paper in the Harvard Law Review, discussed previously on IPBiz and in Intellectual Property Today.
